Estate and Likeness Consent and Takedown Policy

This Policy explains, in one place, how Luqas authorises the creation of a Voice Model, and how anyone with a legitimate interest in a Subject's voice or likeness can object to it. It is incorporated by reference into the Terms of Service (sections 8.1 and 21.4) and does not replace anything stated there; where this Policy and the Terms of Service differ, the Terms of Service control.
2. Who may object
- An Estate Representative, next of kin, or heir of a deceased Subject
- Any living, identifiable third party who appears in Source Material used to create an AI Companion
- Any Subject, or person acting for a Subject, who did not give the permission represented under Terms of Service section 7.2
An objection may be about the existence of the AI Companion itself, or about specific Source Material that includes a third party who never consented to its use.
3. How to object
Contact our designated agent at likeness@luqas.ai. Please include your relationship to the Subject or third party, a description of the AI Companion or material you are objecting to, and the basis for your objection. This channel is separate from the copyright process described in Terms of Service section 11.
4. What happens after an objection
We aim to acknowledge objections promptly and resolve them as quickly as reasonably possible; we do not currently guarantee fixed acknowledgment or resolution timeframes, consistent with Terms of Service section 8.2. Depending on what we find, we will suspend the AI Companion pending resolution, retire it, or explain why we have declined to act, and we will give the account holder an opportunity to respond before a final decision, except where we are legally required to act immediately.
5. Involuntary retirement
In some jurisdictions, a person who never agreed to our Terms of Service can nonetheless compel us to suspend or retire an AI Companion — for example under Article 2-terdecies of the Italian Personal Data Protection Code, Article 3 of Spanish Organic Law 3/2018, or Article 85 of the French Data Protection Act. Where this occurs, the account holder receives a refund of any prepaid subscription fees for the unused period and retains permanent access to their uploaded Source Material, consistent with Terms of Service section 13.
6. Disputes between family members
Where relatives disagree about whether an AI Companion should exist, we suspend it pending agreement between the parties or a determination by a court or competent authority. We do not adjudicate family disputes ourselves, and we do not apply a first-uploader-wins rule. Because Luqas does not link or share data between accounts (Terms of Service section 7.8), a dispute over one family member's AI Companion has no effect on another family member's separately-created AI Companion of the same Subject.
8. Record-keeping
We keep a record of each objection received and how it was handled, for as long as we retain the associated attestation record under Terms of Service section 7.2, for use as evidence in the event of a dispute or claim.
